The Heavy Vehicle National Law (HVNL) designates directors and managers of a corporation controlling or directing the use of heavy vehicles as “Executive Officers,” regardless of their presence during transport tasks.
These officers have an obligation, and hence liability, to exercise “due diligence” to ensure that all parties within the Chain of Responsibility (CoR) comply with their requirements under the HVNL. This involves carefully evaluating the company’s operations to establish safe transportation and performance standards.
